From a woman expecting a baby for a US-based NRI family to another waiting to deliver twins for an Indian couple and to many other women in different stages of pregnancy, the surrogacy bill passed by the Union Cabinet of India in August 2016 came as a massive shock. The proposed new law on surrogacy would push many such women into a legal grey zone.
The Surrogacy (Regulation) Bill 2016 (Surrogacy Bill) came with several clauses, from allowing only heterosexual infertile couples to opt for surrogacy to restricting the woman to became a surrogate only once in her life. The proposed law aimed to end the perceived exploitation of poor women, who were often forced to become surrogates and to protect their rights. However, the bill faced a severe backlash from industry experts, doctors, surrogates, hopeful parents, and analysts. Many opined that the government had to do a rethink on it. ...
